Affiliate Program

This policy statement and agreement defines how we (Green Blaster) will deal with you (the affiliate). It contains the terms of the affiliate program. Please Note: "we", "us", and "our" refers to Green Blaster and "you", "yours", "your" refers to the applicant and affiliate. The term of this agreement starts when you are accepted into the Green Blaster affiliate program and will end upon notice of termination from either you or Green Blaster or expiration of the time periods described in this agreement.

The affiliate program is a referral program under which, subject the following terms, we will pay you, the affiliate, a 15% initial referral fee for orders placed by the customer(s) specifically referred by you as defined below and will pay a follow-up referral fee of 15% for additional orders placed by that customer(s) for up to 180 days.

Green Blaster uses a contractor to collect, process, record and track all affiliate activity. Your application and implementation of this affiliate program acknowledges and accepts the contractor’s terms and conditions in addition to these.

Rights and Restrictions. We reserve the right to accept or reject any affiliate we review for any reason or no reason. All new affiliate requests will be reviewed by us and either accepted or rejected in a reasonable time frame, generally about 72 hours. We will notify you via email of our decision. Green Blaster will make the decision to accept or reject affiliate applications at Green Blaster’s sole discretion. Green Blaster’s decision(s) are final and are not subject to appeal or review for any reason.

Cancellation. The affiliate account may be cancelled by Green Blaster at any time for any reason or no reason. Generally a decision to cancel will be made for mis-representation(s) made to or about us; non-compliance by an affiliate with the ‘CanSpam Act’ or other regulatory requirement; the use of spam e mail to promote Green Blaster or you, the affiliate; mis-use of any Green Blaster logos, imagery or intellectual property; posting Green Blaster links on unapproved websites; uploading affiliate code through unapproved methods, or sites; or the posting or use or sites we, at our sole discretion, feel might bring Green Blaster disrepute or negative public impression. We may opt to provide a warning and a period of time for an affiliate to correct the issue raising the specter of cancellation, or we may not. Affiliates may cancel their account with Green Blaster at any time and for any reason or no reason; cancellation may be done by email.

Access to Account Management Services. On your acceptance into the Green Blaster affiliate program we will email to you the links, passwords, files and related information for you to access to your affiliate account information; this lets you see account activity and set certain account parameters. We suggest you keep these confidential links in a safe place that is easily accessible by you. If you lose this account access information we will be able to re-send it to you.

Use of Graphics and Links, Limitations of Use, and Cookie Periods. Only HTML code and approved link information may be used for and on the affiliate’s website. Failure to do so can result in misappropriated and lost commissions. All of the links, graphics, and account management information provided to the affiliate after acceptance are provided by revocable license and remain at all times the property of Green Blaster. Affiliates may not use any graphics or links not approved by or supplied by Green Blaster in connection with Green Blaster products

When a viewer clicks on an affiliate link and places an order with Green Blaster that viewer becomes the sole customer of Green Blaster, and, for a period of 180 days from the date on which an order is placed referral fees (initial and follow-up) remains payable to the affiliate. The affiliate will not have access to customer account information, contact information, and may not communicate with customer concerning orders placed with Green Blaster. Green Blaster is responsible for all customer service, fulfillment, processing, shipping and order inquiries made by or with customers.

This agreement does not constitute a joint venture, partnership, franchise, or other representative arrangement or relationship between you and Green Blaster. The affiliate is being paid referral fees as an independent contractor and in no way is this to be interpreted as representation of or endorsement by Green Blaster.

Green Blaster may at any time refuse any particular link, text or referring graphic used to forward a viewer to our website. Only approved links, banners, graphics and text may be used. The use of Green Blaster affiliate links, or links referring to a particular affiliate link is strictly prohibited by means of ‘junk mail’, email server programs, spam, hit distribution networks, pay-per-click programs, or through mass distribution in chat rooms, etc. Green Blaster will, in its sole discretion determine "inappropriate use" and may at any time cancel an affiliate and close the related account(s) if we become aware of any inappropriate use. This cancellation may be done without notice or cure opportunity. The cookie period for the Green Blaster affiliate program is exactly 180 days. After this period the viewer must return to the affiliate's website and click a link for commission to be earned. Unless the specific customer has placed an additional order within the time frames described herein.

Commissions will not earned, paid or recorded for activity by viewers who have set their cookie protection settings to a level that precludes our software from properly recording activity as this may block and prevent the necessary cookies from being installed and working as intended thus preventing tracking and accrual of referral fees that you as the affiliate may earn. Green Blaster is in no way responsible for sales or referral fees lost through high security settings, firewall parameters, or any other settings or equipment which prevent the necessary cookies from being installed and working as intended.

International Affiliates. International affiliates may or may not be accepted as we may or may not be able to process orders for international locations. Requests for international affiliates will be reviewed on a case by case basis. International affiliates using sites or the Internet in circumvention of any US laws or regulation will not be permitted.

Referral Fee Payment. Referral fees, initial and follow-up, will accrue to the affiliate’s account in the month following the month in which Green Blaster receives payment. Payment of fees to affiliates will be made on the 15th of the month following the month in which the fees earned are equal to or greater than $50. Green Blaster reserves at all times the right to adjust any amounts payable for any amount owed by the affiliate and or for any referred customer order(s) that are unpaid by the customer for any reason. Referral fees will be calculated as a percentage of the actual order amount paid by the customer, after all discounts and will not be paid on any amounts charged for other than product purchases including but not limited to taxes, shipping or similar charges. Green Blaster reserves the right to void earned referral fees from orders determined to be fraudulent or improper. Additionally, Green Blaster reserves the right to offset credit card disputed amounts made within the terms of the credit card used which in some cases may be up to 24 months following the original transaction. All payments will be made in US funds and will only be made by check (not through PayPal, credit card or other mechanism).

We may from time to time receive orders that we deem to be fraudulent or improper as may be the case with stolen credit cards or credit card numbers. We may cancel or decline to process or attempt to cancel shipping or recover a shipment on a transaction we believe to be improper. No fees will be earned on such orders and an excessive amount of such orders will result in cancellation of your affiliate account(s). We will cooperate with all authorities and credit card processors investigating such orders and will turn over any information, including affiliate information, in connection therewith. Green Blaster, in its sole discretion, reserves the right to accept or decline any order(s).

Grant of License and Restricted Use Green Blaster grants you a non-exclusive, non-transferable, revocable right to use our banners, advertisements, links, trademarks, logos, and computer code solely for the purpose of advertising the Green Blaster website and its products. Green Blaster holds sole editorial discretion on how links are worded or described on the affiliate’s site. Green Blaster is not responsible for the creation of the links, which may be posted on your site and will only be involved on editorial review. You, the affiliate, also agree to fully cooperate with Green Blaster to maintain and manage links. All content on the affiliates website including links, banners, text, etc, leading to any or all content within the Green Blaster website is the sole responsibility of the affiliate. Because of the constantly changing nature of the Green Blaster website, we hold it to be the affiliate’s responsibility to update and manage their own links leading to the Green Blaster website. We are not responsible for alerting the affiliate, making recommendations on when we anticipate changing the links or directions to content on the Green Blaster website or to provide any notice of change(s). If Green Blaster believes that fraudulent activities have been recorded within your account as a result of masking links, multiple clicks or through embedding code in a hidden fashion within your pages, or if the commission links have been exploited in any other way, we reserve the right to cancel any or all commissions and close the account.

Changes To This Agreement. Green Blaster may change the wording and structure of these terms at any time. When a change to these terms and agreements occurs affiliates will be notified within 48 hours.

Privacy. Your privacy is a major concern for Green Blaster. We will not sell, trade or otherwise share your account information to any organization outside of Green Blaster except in accordance with the terms herein or any legal or regulatory requirement.

Guarantees. Green Blaster makes no warrantee, guarantee or assurance on the ability of this affiliate program to generate income for affiliate(s) or applicant(s). We specifically decline any warranty or assurance including, but not limited to, traffic generated, revenue earned, and functionality of the affiliate program.

Limitations of Liability. We will not be liable to you with respect to any subject matter of this agreement under any contract, negligence, tort, strict liability or other legal or equitable theory for any indirect, incidental, consequential, special or exemplary damages (including, without limitation, loss of revenue or goodwill or anticipated profits or lost business), even if we have been advised of the possibility of such damages. Further, notwithstanding anything to the contrary contained in this agreement, in no event shall green blaster accumulate liability to you arising out of or related to this agreement, whether based in contract, negligence, strict liability, tort or other legal or equitable theory, exceed the total commission fees paid to you under this agreement.

Indemnification. You agree to indemnify and hold harmless Green Blaster and its employees, representatives, officers, agents and affiliates, against any and all claims, suits, actions, or other proceedings brought against Green Blaster based on or arising from any claim(i) That our use of any material provided by you infringes on any copyright, patent, trademark, trade secret or any other intellectual property right of any third party, or(ii) Resulting from your breach of this Agreement or resulting from your breach of any third party intellectual property right or misappropriation of any material, or resulting from any of your defamatory, libelous act or resulting from your violation of any third party right of publicity or privacy. You will pay any and all costs, damages, and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against or otherwise incurred by Green Blaster in connection with or arising from any such claim, suit, action, or proceeding.
